Welcome to codiocigarshops.com, operated by Codio Cigars LLC, doing business as Codio Cigars Shop. By accessing or using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

  1. Age requirement (21+). You must be at least 21 years old to use this Site or purchase any product. By using the Site you represent that you are 21 or older. We verify age at checkout and may require age verification again on delivery. Orders that fail age verification will be cancelled.
  2. Products and tobacco use. We sell premium cigars, tobacco products, and related accessories. Tobacco products are not risk-free. You are responsible for complying with all laws that apply to buying, possessing, and using tobacco where you live.
  3. Accounts. If you create an account, you are responsible for keeping your login secure and for all activity under it. Provide accurate information and keep it current.
  4. Orders and pricing. All orders are subject to acceptance and availability. We may refuse or cancel any order, including for suspected fraud, pricing errors, or failed age verification. Prices and promotions may change without notice; obvious pricing errors are not binding on us.
  5. Payment. Payment is due at checkout through our payment providers. By submitting an order you authorize us to charge your payment method for the total, including taxes and shipping.
  6. Loyalty and promotions. Points, rewards, referral credits, and gift cards are subject to their own terms and may be changed or ended at any time. They have no cash value except as required by law.
  7. Intellectual property. All content on the Site — logos, text, images, and brand designs — is owned by Codio Cigars LLC or its licensors and may not be copied or used without permission.
  8. Limitation of liability. The Site and products are provided “as is.” To the fullest extent allowed by law, Codio Cigars LLC is not liable for indirect or consequential damages arising from your use of the Site or products.
  9. Governing law. These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law rules. Any disputes will be handled in the courts located in New Jersey.
  10. Changes. We may update these Terms at any time; continued use of the Site means you accept the updated Terms.
  11. Substitutions and availability. If an item in a sampler or set is out of stock, we may substitute a cigar of equal or greater value. Product photos are representative; actual color, shade, and size may vary slightly.
  12. Age verification. We verify age at checkout and may use a third-party age-verification service that checks public records. If your age or identity can’t be confirmed, we may ask for a copy of a government-issued ID or cancel the order. Entering a false date of birth to appear 21+ may result in cancellation and a cancellation fee.
  13. Sales and excise taxes. Applicable sales tax and, where required, tobacco excise tax are calculated at checkout based on your delivery (not billing) address, and are collected and remitted as required by law. International customers are responsible for any import duties or taxes charged by their own country.
  14. Where we ship and transfer of title. We ship within the U.S. (all states) and internationally to any country where it is legal, except mainland China (Hong Kong and Macau are eligible). Title to the goods passes to you when the order is handed to the carrier. By ordering, you affirm you are of legal age and legally permitted to receive tobacco at your address, and that you are responsible for complying with your local, state, and national laws, including any import duties or customs requirements.
  15. Payment and fraud prevention. We accept major credit and debit cards (processed by Stripe) and PayPal, including international cards. To prevent fraud, some orders may be held briefly for verification, and we may cancel an order if payment or billing details cannot be confirmed.
  16. Prohibited uses. You agree not to use the Site for any unlawful purpose, to resell our products, to scrape or data-mine the Site, to interfere with its security or operation, to impersonate anyone, or to upload malicious code.
  17. Indemnification. You agree to hold Codio Cigars LLC and its owners and staff harmless from any claims, losses, or expenses (including reasonable legal fees) arising out of your misuse of the Site or your violation of these Terms or any law.
  18. Electronic communications. By using the Site, contacting us, or completing forms, you consent to receive communications from us electronically and agree that electronic agreements and records satisfy any legal requirement that they be in writing.
